Golf carts, specialty license plates included in 2013 laws

All or parts of the following Nebraska laws will go into effect Tuesday:

LB 14: Changes fees for deeds, mortgages, wills and other papers within a county's register of deeds.

LB 216: Creates a special interest license plate for classic cars that aren't used for regular travel.

LB 536: A law designed to give counties additional notice that property is changing hands because of a death.

LB 854: Gives businesses that have been dissolved up to five years to apply for reinstatement with the Nebraska secretary of state's office.

LB 887: Reduces filing fees and changes other rules for Nebraska insurance companies.

LB 1058: Requires employers to send information about a worker's eligibility for unemployment benefits to the state within 10 days of the Department of Labor requesting it.

LB 1080: Establishes tax breaks for data centers that locate in Nebraska.

LB 1091: Requires Nebraska retailers to collect a surcharge on prepaid cellphones and phone cards.

LB 1113: Sets rules in legal matters involving powers of attorney.

Since I don?t track Elsa Pataky the way she wants me to I?d no idea she cut off all her hair and, she wasn?t blonde before, was she? For the purposes of this blog then, let?s decide that she wasn?t and that this is new. And it looks good the way her hair is flat against her head, the envy of Asians like me who cannot grow it like this, and not unlike Sienna Miller who wore it similarly when she had it short.

Pacific gets insurance, puts dissolution or annexation on hold ...

The City of Pacific got a last minute reprieve on Wednesday with the City Council voting to accept an offer of insurance coverage for 2013.

The new policy will provide about half the coverage of the new insurance and cost more money, but it will stave off the possibility of the city having to annex into Auburn or cease to exist.

"You need liability insurance to operate the city, the employees need to have some sort of liability coverage, coverage on all the vehicles, coverage for anyone that may get hurt," Council President Leanne Guier told King 5 News.

The city was informed in July that it's previous policy with the Cities Insurance Association of Washington would be cancelled on Dec. 31 if "swift, concrete and verifiable deeds to bring a more stable and professional environment to the City of Pacific" were not made.

At the time of the notice the city was without any major department heads, all of whom had either resigned or been fired by controversial Mayor Cy Sun.

Although the city began to fill vacancies after Sun was ordered by a Pierce County Superior Court judge to hire new personnel, a plea to the CIAW to extend coverage for Pacific was denied.

Facing operating without liability insurance ? which would leave city employees, elected officials and police officers personally liable ? the council drafted resolutions to either annex into Auburn or put a vote to dissolve the city before residents.

Both resolutions were permanently tabled by the council on Wednesday after the vote to accept the new policy.

The city's new policy provides $5 million in coverage, about half the previous policy, and at a higher cost.

Pacific is currently facing nearly $10 million in lawsuits filed by former employees.

After being absent from the previous two meetings regarding annexation and dissolution, Sun was in attendance and defiant at Wednesday's meeting.

"You people want to vote me out, go ahead and do it," he told the audience.

?...by golly I'm staying in and I'm doing exactly what the people voted me in for,? he added.

Many blame Sun's confrontational leadership style for the 103-year-old city's woes, including the Committee to Recall Cy Sun, who have mounted a campaign to put a recall vote before the people.

Currently the recall effort is raising money to pay their lawyers so the case can be considered by the Washington State Supreme Court. A previous decision by the King County Superior Court ruling there was sufficient cause for recall was appealed by Sun.

A recall vote could come as early as April.

New Year's Resolutions: 8 Ideas For Better Sleep In 2013

Finding yourself making the same tired resolution to get fit or lose weight or eat more nutritious foods?

You're not alone. New Year's resolutions are successful 39 percent of the time among young people, and only 14 percent of the time among people who are 50 or older.

But there's a reason -- or a few -- why you didn't reach your goal this go round. Maybe your plan was too complex or not measurable or too vague. Or maybe you've been struggling with healthy living because you've been ignoring an essential (yet often overlooked) pillar of good health: sleep.

Sleep, just like physical activity and a balanced diet, is crucial for optimal health, HuffPost blogger Russell Rosenberg, Ph.D., CEO of the Atlanta School of Sleep Medicine and chairman of the board of the National Sleep Foundation, told HuffPost. "It's an important piece to the overall health puzzle."

  • Power Down An Hour Before Bed

    Nearly all Americans -- as many as 95 percent, in fact -- use some tech gadget in the hour before bed at least a couple of nights a week, according to the National Sleep Foundation's <a href="http://www.huffingtonpost.com/2011/03/07/sleep-in-america-poll_n_832457.html">2011 Sleep In America poll</a>. But the <a href="http://www.huffingtonpost.com/2012/03/13/ipad-use-bedroom-sleep_n_1339346.html">blue light emitted</a> from TV, laptop, tablet and smartphone screens disrupts the brain's natural melatonin production and can trigger alertness, keeping you awake later. Experts recommend going screen-free about an hour before bedtime and picking a less disruptive way to unwind during that time instead. In 2013, why not try a warm bath, a good book or some <a href="http://www.huffingtonpost.com/dr-michael-j-breus/yoga-insomnia_b_1939696.html">nighttime yoga</a>?

  • Leave The Cell Phone Outside The Bedroom

    <a href="http://www.huffingtonpost.com/2012/08/16/smartphone-addiction-time-survey_n_1791790.html">Half of Americans sleep next to their cell phones</a>, according to a Time magazine poll. More than 80 percent of 18-24 year olds are guilty of this sleep no-no. Not only is the blue light emitted a problem, but middle-of-the-night texts and emails can disrupt your sleep as well. In the new year, resolve to leave your phone charging in another room so you're not tempted to check it when you stir. If you must keep it nearby, turn it to a mode that allows only emergency calls to wake you. <a href="http://www.huffingtonpost.com/2012/09/06/bedroom-sleep_n_1847576.html">Invest in a regular alarm clock</a> so you have no excuses.

  • Commit To At Least 7 Hours

    It's true that there's no magic number of hours of sleep that every adult must get, but in general, <a href="http://www.sleepfoundation.org/alert/how-much-sleep-do-you-really-need">most people require about seven to nine hours</a> to feel and function their best. Risk for a number of the serious consequences of short sleep, like heart problems and obesity, increases dramatically when people get <a href="http://www.health.com/health/condition-article/0,,20573185,00.html">fewer than six hours a night</a>. Calculate seven hours back from the time you need to wake up, then hit the hay as close to that time as possible. Take into consideration <a href="http://www.huffingtonpost.com/dr-christopher-winter/sleep_b_2084339.html">how long it takes you to fall asleep</a> and whether or not you wake up frequently throughout the night.

  • Stick To The Schedule

    Both staying up past your bedtime for a Saturday night out and staying in bed late on a Sunday morning can wreck havoc on your sleep. Throwing off your bedtime and wake up schedule even by just an hour <a href="http://www.huffingtonpost.com/2012/11/13/twelve-tips-for-better-sleep_n_2101579.html">disrupts the body's natural clock</a>, called circadian rhythms. Researchers have given a name to this practice of adopting different sleep habits for the weekdays and the weekends: "social jet lag." If you're guilty of this practice, come Monday morning, you'll likely feel as if you're adjusting to a different time zone. <a href="http://www.huffingtonpost.com/2012/05/11/social-jet-lag-weekend-harm-health_n_1507396.html"> Social jet lag has been linked to higher body mass index</a>, and may also raise risk of obesity or diabetes, like shift work has been shown to, Health.com reported. As much as possible, set a sleep and wake schedule that works for you -- seven days a week.

  • Consider What (And When) You Eat And Drink

    If you rely too heavily on that 4:30 p.m. cup of coffee or that glass of wine before bed, consider committing to healthier eating and drinking habits for sleep in the coming year. Experts recommend <a href="http://www.huffingtonpost.com/2012/11/13/twelve-tips-for-better-sleep_n_2101579.html#slide=1739454">ditching caffeine six to eight hours before bed</a> to make sure it's out of your system by lights out time. Alcohol, while it <em>can</em> help lull you to sleep, is <a href="http://www.huffingtonpost.com/russell-rosenberg-phd/alcohol-sleep_b_902578.html">only disruptive later on in the night</a>. It's also a good idea to <a href="http://www.huffingtonpost.com/2012/07/20/sleep-foods_n_1686983.html#slide=1248119">steer clear of fatty foods</a> too close to bedtime, since they can lead to fewer hours of sleep, and sleep-disrupting issues like indigestion and <a href="http://www.huffingtonpost.com/2012/11/01/acid-reflux-food_n_2019932.html">acid reflux</a>.

  • Stop Badmouthing Sleep

    When's the last time you heard someone brag about cutting a night short in order to hit the hay? It's much more likely you've heard something along the lines of "I'll sleep when I'm dead." But short sleep isn't a sign of bravery or competence or toughness. In fact, <a href="http://www.huffingtonpost.com/2012/05/17/sleep-quotes_n_1525828.html">sayings like this send messages about sleep</a> that all too often paint a negative picture of good rest. Continuing to spread belittling messages about sleep hurts us all -- in 2013, commit to doing your part to change our national attitude toward sleep.

  • If You Really Can't Sleep, Get Up

    Getting out of bed may be the last thing you feel like doing when counting sheep just won't work, but it can actually help you fall back to sleep faster -- and reduce the stress of staring at the clock. "When a person stays in bed and they can't sleep, the bedroom can induce a certain level of anxiety," Michael Decker, Ph.D., an associate professor at Georgia State University and spokesman for the American Academy of Sleep Medicine, <a href="http://www.huffingtonpost.com/2012/08/03/cant-sleep-home-remedies_n_1739190.html#slide=1328737">told HuffPost earlier this year</a>. "We say after 15 or 20 minutes, get out of bed, sit in another part of the house until you feel a little groggy, then go back to sleep. Staying in bed can condition you to become anxious in bed."

Egypt president warns against new unrest

CAIRO (AP) ? Egypt's Islamist president warned against any unrest that could harm the drive to repair the country's battered economy in his first address before the newly convened upper house of parliament on Saturday, urging the opposition to work with his government.

In the nationally televised speech, Mohammed Morsi said the nation's entire efforts should be focused on "production, work, seriousness and effort," now that a new constitution came into effect this week, blaming protests and violence the last month for causing further damage to an economy already in crisis since the fall of autocrat Hosni Mubarak.

Citing the economy, Morsi pressed the opposition to drop its refusals to deal with his government, repeating his invitation for it to join a national dialogue he has been holding ? and adding a warning that appeared directed at the opposition not to turn to protests that might cause unrest.

All sides must "realize the needs of the moment" and work only through "mature democracy while avoiding violence," he told the 270-member Shura Council. "We condemn and reject all forms of violence by individuals, groups, institutions and even from the nation and its government. This is completely rejected."

Last month, the largely secular and liberal opposition launched a wave of protests against decrees by Morsi grabbing new powers ? since revoked ? and against the draft constitution that his Islamist allies rammed through to finalization and put to a referendum, completed a week ago. In response, Islamists also launched mass rallies, and the two sides erupted into violence several times. The worst violence came in clashes outside the presidential palace in Cairo that killed 10 people, and though it was sparked when Islamists attacked a sit-in, Morsi's allies have depicted the opposition as to blame.

Opponents fear that Morsi and the Muslim Brotherhood, from which he hails, are monopolizing rule and that the new constitution will consecrate their power. The charter allows for a stronger implementation of Islamic law, or Shariah, than in the past and provisions that could limit many civil rights and freedoms of minorities. The charter was passed by 64 percent in the referendum, though turnout was only around 33 percent.

Under the new constitution, the upper house of parliament, which normally has few powers, is now serving as the law-making body until a new legislating lower house is chosen in national elections expected within a few months. The upper house, called the Shura Council, has an overwhelming Islamist majority, mainly from Morsi's Brotherhood and the allied ultraconservative Salafis.

Morsi has depicted the national dialogue that he launched earlier this month as a compromise giving all factions a voice. The dialogue is supposed to draw up key legislation to put before parliament, including a law organizing the parliamentary elections, and decide other issues. The opposition has dismissed the dialogue initiative as disingenuous, and so far mainly Islamists are participating, along with a few small liberal parties.

Ahmed Maher, head of the activist April 6 Movement that helped engineer last year's uprising against Mubarak, said Morsi's speech offered nothing new beyond his acknowledgement of Egypt's economic woes. He also said he would not enter into talks again with the president until the Brotherhood "gives up some of their arrogance and stubbornness."

"I sat with the president four times before. There are never any clear results from the conversations," Maher said, adding that the opposition wants changes to the new constitution and a Cabinet led by a new prime minister with a clear plan.

In his speech, Morsi repeatedly said it was time to return to "production" and "work." While he listed some new economic projects such as developing the Suez Canal area and Sinai, he did not give details on an overall economic program, including how the government will tackle a crippling deficit or carry out expected changes in taxes or reductions of subsidies.

Morsi acknowledged in his nearly hour-long speech the country's dwindling foreign currency reserves, which stood at around $36 billion in 2010 before the uprising and now hover around $15 billion, bolstered by large Qatari deposits.

His government has requested a $4.8 billion loan from the International Monetary Fund to bridge the burgeoning budget deficit. But talks have been put off for the moment after the government this month backed off plans to raise taxes on a number of products, fearing a larger backlash amid the political protests. Potential cuts in subsidies on food and fuel and plans to raise taxes are major concerns in a country where some 40 percent of the 85 million population live near or below the poverty line of surviving on $2 a day.

Standard & Poor downgraded Egypt's long-term credit rating one level this week to B-, six steps below investment grade.

"The reason (for the lower ranking) is the lack of political stability in the recent past," Morsi said.

He denounced those he said were spreading rumors that undermine the economy. "Those who talk about bankruptcy, they are the ones who are are bankrupt. Egypt will never be bankrupt and will not kneel, God willing," he said to a round of applause.

And he appeared to chide the opposition for not working with him, saying all sides must past through the crisis together. "We all know the interests of the nation. Would any of us be happy if the nation goes bankrupt? I don't doubt anyone's intentions. But can anyone here be happy if the nation is exposed to economic weakness?"

In attendance at the session were leading national figures such as Egypt's new Coptic pope, Tawdros II, seated next to the country's top mainstream cleric, grand sheik Ahmed al-Tayeb of Cairo's Al-Azhar, Sunni Islam's foremost seat of learning. The former head of the ultraconservative Salafi Nour Party and the head of the Muslim Brotherhood party were also seated front-row along with former interim prime ministers, the country's defense minister and other members of Cabinet.

Smart TV owners seemingly tuning out most apps

They may be called smart TVs, but that doesn?t stop the vast majority of us from using them as basic boob tubes. A new NPD Group report claims that most people use their Internet-enabled televisions to stream video services like Netflix or Hulu Plus, and?? actually, not much else.

Streaming music services manage to entertain around 15 percent of smart TV owners, but all of the more ballyhooed interactive aspects of Internet-enabled TVs???think Facebook, Twitter, Web browsers, and all those apps, games, and email widgets that come preloaded in newer HDTVs???are left completely untouched by most people.

The NPD Group?chalks the trend?up to a few different factors, the biggest of which being the simple fact that most people consider televisions sets to be, well, televisions???not computing devices. The proliferation of secondary Internet-enabled devices (like consoles and Blu-ray players) and the rise of local digital streaming options (like AirPlay, DLNA, and Samsung AllShare) may also be both confusing customers and cannibalizing traditional smart TV services, NPD theorizes.

We?ll add another possible factor: The molasses-slow processors in most smart TVs make anything beyond simple content streaming a major usability pain. Trying to browse your Facebook News Feed on a television is often a tremendously laggy exercise in frustration.

Fortunately, consumer disinterest in the Internet-enabled bells and whistles may just make the basic video-streaming functions of smart TVs more pleasant to use going into the future???at least if manufacturers listen to the NPD?s closing advice: ?Focus less on new innovation in this space and more on simplification of the user experience.?

From its November 2008 market lows, the?SPDR Gold Trust (NYSEARCA:GLD)?- the No. 1 proxy for the ?yellow metal? ? rose as much as 158%, reaching its peak in September 2011. But it?s down about 13% since that time (though it?s up 5% year to date), and a lot of folks are wondering what gold is worth, and how they should play it.

Wall Street?has grown more tepid on gold, with many of the investment banks ratcheting back just a bit on their target prices. But most also see prices heading up to and beyond the $2,000 level in 2013, meaning they see a potential gain of 22% or better.

Peter?s target price is a bit more aggressive: He sees gold trading as high as $2,200 an ounce ? 34% above current prices in the $1,640 range.

I?ve worked with Peter for several years now, and admire the way he works.

He based himself in resource-rich Canada in order to be closer to the many companies that he covers. And he?s made a number of truly superb market calls: In September 2010, for instance, when silver was trading at $19 an ounce, Peter told investors the metal was a??Buy??- and we then watched it soar to a high of $48 (a 153% windfall).

So when I decided to bring you the latest insights on gold ? and some recommendations, as well ? I went to Peter.

Insights on Investing in Gold

His answer: Physical bullion remains a top play; the physical metal is a vehicle for profit,?and?will serve as an excellent hedge against inflation and the many problems that remain in both the global and domestic U.S. economies.

But gold miners (NYSEARCA:GDXJ) are so cheap that they, too, deserve a look.

Well, at least?some?of them do.

?Bill, you?ll see statements from some of Wall Street?s big guns that gold miners are cheap right now,? Peter told me during a telephone chat last week. ?And that?s true. They are cheap on a numerical [fundamental] basis, especially compared with historical valuations. But gold miners are cheap in another way, too ? a way that Wall Street?s either not telling us about, or just doesn?t understand.?

Needless to say, that last statement grabbed my attention. And I told him so.

Peter laughed, and then went on with his commentary.

?Over the last decade or so, the best of these companies have aggressively expanded their reserves. They?ve done so organically ? that is, developed properties themselves. And they?ve done so by purchasing small development-stage, or production-stage players,? Peter said. ?Investors don?t realize just how much it costs to add reserves ? especially if a company is doing so by itself. That?s particularly true today, with all the regulations and public protests boosting environmental and compliance costs.?

Statistics Peter provided bear this out. In 1991, there were 11 gold discoveries. Twenty years later ? in 2011 ? there were three. And companies spent?$8 billion?looking for new strikes that same year.

?So you see, Bill, that the miners that already added reserves had tremendous foresight,? Peter said. ?Having spent a number of years just growing their reserves, all it will take to reap the payoff will be some event that kicks off a mania in?gold prices. And we?re not talking about longshot odds for that to happen. All you need is the ?right? set of events, either domestically or globally, to cause gold prices to rise. When that happens, gold-mining stocks will be off to the races.?

Gold prices?have suffered of late because of a strong?U.S. dollar. That surprising strength (in the face of the whole ?fiscal-cliff? mess) stems from the fact that worries about Europe have transformed the dollar into a ?safe-haven? investment.

Gold and the dollar are negatively correlated because gold is priced in dollars, but most of the buyers aren?t in dollar-based economies. (Because these buyers are?Swiss,?Indian?or?Chinese, just to name a few, they look at the price of gold in?Swiss francs,?Indian rupees?or?Chinese renminbi. And if the U.S. dollar is strong, the?price of gold?in dollars is weak ? even if the native currency price remains the same.)

So the rise we?ve seen in the dollar has been accompanied by a sell-off in gold.

Investing in Gold Stocks

Naturally, that sell-off in gold has affected gold stocks.

Over the past three months?Newmont Mining Corp. (NYSE:NEM)?is down about 21% and?Barrick Gold Corp. (NYSE:ABX)?is down about 20%, but the SPDR Gold Shares ETF is down only about 5%.

Looking ahead, the?U.S.?Federal Reserve?s?plan to continue printing money (and that of the?European Central Bank (ECB), or the new stimulus plan we?re likely to get from the?Bank of Japan (BOJ)?should be very good for gold.

And a jump in gold prices will be even better for gold miners.
The reason for that is called??leverage.?

When gold prices jump, a gold-producer sees its earnings accelerate at a faster pace than the price of the actual metal.

I saw a hypothetical in a recent edition of?USA Today?that explains this perfectly.

For example, if you own a mine that can produce gold for $1,100 an ounce, but gold is trading at $1,200, you?re making a profit of $100 an ounce.

But what if gold jumps from that $1,200 price level to, say, $1,500? That?s a price increase of $300, or 25%. For the gold miner, however, profits have jumped from $100 to $300 ? a 200% gain.

Two miners to consider are?Newmont Mining Corp. (NYSE:NEM)?and?Barrick Gold Corp. (NYSE:ABX).

?One of the ones that I like is Newmont,? Peter told me. ?It has a very good dividend yield of nearly 3.2%. It?s well-diversified geographically. The stock has gone sideways for a very long time and now the company is making a very concerted effort to keep its costs down.?

Then there?s the?Toronto-based Barrick, the world?s biggest gold producer.

?Barrick, like other miners, has seen that investors are not exactly thrilled with the performance of their shares,? Peter said. ?The reason for that is that the company spent a number of years just growing its reserves. But it did so by using its own stock as currency to buy the smaller companies that we talked about earlier. That was very dilutive.?

But Barrick has suddenly gotten religion ? of the shareholder variety. In June, it fired?CEO Aaron Regent?after less than four years on the job: Board members were apparently peeved that the company?s share price didn?t move during that period, despite the huge run-up in gold prices.

?Going forward, just from the signs or evidence that I?ve seen, the company has adopted a much more investor-attentive attitude ? and the ouster of the CEO is just one bit of that evidence,? Peter said. ?The company is trying to focus on keeping its costs in line. And it?s trying to produce the hell out of what it already has in the ground. The odds are high that we?ll have a pretty good six to 12 months to come.?

Barrick?s 2.4% dividend isn?t bad either ? especially because of the current??zero-interest-rate-policy? (ZIRP) environment.

There are some people who say there is no simple way to lower the high cost of healthcare. They?ll tell you the problems are too complex and the system too entrenched. But I disagree. My story?. Guidance..

In 2006, like many I was a hopeless person trying to find my way in this business world. Back then I just left University to pursue this world we called ?Business?. With only $20 in my pocket, I embarked on it by purchasing a few pieces and then manage to borrow from my dad to buy a whole carton of the Clay Soap. Surprising the product caught on with the relatives with the help of my Mum. She?s this telemarketeer who would called up every single Aunt to let them know of this new product.

In a few months I took the product to the stores, built a website with just $150 for the domain and web hosting. ?And from there that $20 turn to hundreds per month offline. The product was selling very well offline, however the website I built did not garner much attention. The only way I know how to market back then was to email to a group of my friends and contacts in NUS.

To expand the business I need to know more people, so I signed up for an entrepreneurship?workshop at SMU which led ?to my Mentor known as Abang Abu. He then introduced me to a Malaysian Internet Millionaire ? Dr Irfan Khairi which opened the way for me to learn more about Online Marketing.

The lessons covered in the workshop by Dr Irfan Khairi was very simple to create wealth online. You just need a Page with all the information about your product or Service. Drive Traffic via the various ways & Monitor them. Sales will eventually be made and from there you have to implement after sales tactics to gain more business.

Netflix suffers Christmas Eve outage, points to Amazon

NEW YORK (Reuters) - An outage at one of Amazon's Web service centers hit users of Netflix Inc.'s streaming video service on Christmas Eve and was not fully resolved until Christmas day, a spokesman for the movie rental company said on Tuesday.?

The outage impacted Netflix subscribers across Canada, Latin America and the United States, and affected various devices that enable users to stream movies and television shows from home, Netflix spokesman Joris Evers said. Such devices range from gaming consoles such as Nintendo Wii and PlayStation 3 to Blu-ray players.?

Evers said that the issue was the result of an outage at an Amazon Web Services' cloud computing center in Virginia, and started at about 12:30 p.m. PST (2030 GMT) on Monday and was fully restored Tuesday morning, although streaming was available for most users late on Monday.?

"We are investigating exactly what happened and how it could have been prevented," Evers said.?

"We are happy that people opening gifts of Netflix or Netflix-capable devices can watch TV shows and movies and apologize for any inconvenience caused last night," he added.

An outage at Amazon Web Services, or AWS, knocked out such sites as Reddit and Foursquare in April of last year.?

Amazon Web Services was not immediately available for comment. Evers, the Netflix spokesman, declined to comment on the company's contracts with Amazon.

Cliff looms: Kicking the Can, Washington-style

WASHINGTON (AP) ? When it comes to the nation's budget challenges, congressional leaders are fond of saying dismissively they don't want to kick the can down the road.

But now, a deadline hard ahead, even derided half-measures are uncertain as President Barack Obama and lawmakers struggle to avert across-the-board tax increases and spending cuts that comprise an economy-threatening fiscal cliff.

Congressional officials said Wednesday they knew of no significant strides toward a compromise over a long Christmas weekend, and no negotiations have been set.

After conferring on a conference call, House Republican leaders said they remain ready for talks, urged the Senate to consider a House-passed bill that extends all existing tax cuts, but gave no hint they intend to call lawmakers back into session unless the Senate first passes legislation.

"The lines of communication remain open, and we will continue to work with our colleagues to avert the largest tax hike in American history, and to address the underlying problem, which is spending," the leadership said in a statement.

A short while later Senate Majority Leader Harry Reid, D-Nev. countered that the House leadership should allow action on a Senate-passed bill that lets income tax rates rise only on incomes above $200,000 for individuals and $250,000 for couples. The measure could "pass tomorrow" if put to a vote, he said.

The Senate is due in session Thursday, although the immediate agenda includes legislation setting the rules for government surveillance of suspected spies and terrorists abroad, including Americans, as well as a measure providing $60 billion for victims of Superstorm Sandy.

Obama decided to cut short his Hawaii vacation for an overnight flight expected to get him back to the White House on Thursday.

Apart from the cliff, other financial challenges loom for divided government, where political brinkmanship has become the norm. The Treasury disclosed during the day it would take accounting measures to avoid reaching the government's borrowing limit of $16.4 trillion by year's end. The changes will provide about two months of additional leeway.

Separately, spending authority for much of the government will expire on March 27, 2013.

After weeks of negotiations, the president urged lawmakers late last week to scale back their ambitions for avoiding the fiscal cliff and send him legislation preventing tax cuts on all but the highest-earning Americans and extending unemployment benefits for the long-term jobless. Longer, term, he said he still supports deficit cuts that were key to the earlier talks.

"Everybody's got to give a little bit in a sensible way," he said at the White House.

The House has no plans to convene, following last week's rebellion in which conservatives torpedoed Speaker John Boehner's legislation to prevent scheduled tax increases on most, while letting them take effect on million-dollar wage earners.

"How we get there, God only knows," the Ohio Republican said of efforts to protect the economy ? and taxpayers ? from the tax increases and spending cuts.

"Now is the time to show leadership, not kick the can down the road," Senate Majority Leader Harry Reid, D-Nev., said a little over a week ago after Boehner announced he would shift his own focus from bipartisan talks to the approach that eventually was torpedoed by his own rank and file.

It's a phrase that political leaders use when they want to suggest others want to avoid tackling major problems, and one that Boehner, House Majority Leader Eric Cantor of Virginia and even Obama as well as Reid have used.

"We have a spending problem. We have to address it, And we're not going to address it by kicking the can down the road," the speaker said at a news conference late last week when he was asked about setting a vote on a plan that Democrats find acceptable.

Cantor recently used the same approach in challenging Obama to agree to savings from Medicare and other benefit programs. "This has to be a part of this agreement or else we just continue to dig the hole deeper, asking folks to allow us to kick the can down the road further and that we don't want to do," he said on Nov. 28.

In fact, it's a phrase that has been in use for over a year as Obama and Republicans jockey for position on pocketbook issues.

In July 2011, when he was struggling with Republicans over the threat of a first-ever government default, Obama said he had "heard reports that there may be some in Congress who want to do just enough to make sure that America avoids defaulting on our debt in the short term. But then wants to kick the can down the road when it comes to solving the larger problem, our deficit."

A few months later, an extension of a payroll tax cut was the issue, and Boehner was insisting on a year-long renewal rather than the temporary plan that passed the Senate with votes from lawmakers in both parties.

"How can you do tax policy for two months?" he asked on Dec. 18, 2011. "I believe that two months is just kicking the can down the road.

"The American people are tired of that."

At issue now is series of tax increases and spending cuts scheduled to kick in with the new year that economists caution could send the economy into a recession.

Expectations are everything when it comes to movies. Spend too much time looking forward to a film and you only set yourself up for disappointment. Keep the relentless marketing hype at bay and you're far more likely to appreciate even the partial successes most movies manage to achieve. Though expectations were pretty high this year, the films of 2012 generally exceeded them. Sure, there were some spectacular high-profile failures (Prometheus and John Carter come to mind). But for every by-the-numbers insult to the American moviegoer, there was another big-budget film that overcame its corporate origins by sheer forces of will and imagination. In 2012, Hollywood's biggest studios consistently handed the reins to visionary filmmakers with often-remarkable results (see Sam Mendes's Skyfall or Joss Whedon's The Avengers). It was a very good year for movies.

??Those successes are all the more striking given the long, slow decline of the large and historic Hollywood studios in recent years. In 2012, studios further embraced their substantial new roles as marketers and distributors of films made by people outside the studio system. There was a time when each studio created its own identity through the films it chose to produce. Today, even those who work in Hollywood will tell you privately that they have trouble telling the studios apart. At the same time, what truly constitutes an independent film has gotten harder to discern as long-held divisions continue to blur. Maybe the best thing about the year in movies is that labels and categories seemed meaningless as never before. When quality and originality start to look like shared values, things are going well.

??The most lovable movies of 2012 were those that transported us completely to places we didn't know existed. In some cases, that's because these places didn't really exist until they were brought to life on film. Three movies fit that bill better than any others released this year: Beasts of the Southern Wild, Moonrise Kingdom, and The Dark Knight Rises. Each seems to thrive in a world entirely of its own devising and succeed only on its own self-defined terms. What follows is a purely-subjective-no-apologies Top 10 movies of the year, presented in alphabetical order. Several highly anticipated 2012 films, including Zero Dark Thirty and Amour, have not yet screened for local print reviewers and are not under consideration here:

Argo ? Director Ben Affleck proves it's still possible to make an old-fashioned Hollywood thriller with neither cynicism nor flag-waving at its core.

Beasts of the Southern Wild ? New Orleans filmmaker Benh Zeitlin and his ragtag crew made history with a magical and utterly original work of Louisiana art.

Beauty Is Embarrassing ? This unassuming documentary about artist Wayne White has charm to burn and provides welcome sustenance for creative types.

The Dark Knight Rises ? Is it possible to bring the depth and vision of a great art film to the world of cinematic superheroes? It is now.

Django Unchained ? Quentin Tarantino goes way over the top with his spaghetti Southern, but his exuberance and obvious love for movies are hard to resist.

Jeff, Who Lives at Home ? Metairie's Duplass brothers transcend their mumblecore roots with a sweet and heartfelt tale of personal redemption.

Lincoln ? Seldom has the majesty of great ideas been depicted so convincingly on film.

Marley ? This gorgeous documentary strips away the false veneer that's always applied to cultural icons, revealing a great man with a remarkable life story.

Moonrise Kingdom ? Director Wes Anderson finally channels his huge talent into a great and memorable film by recreating the childhood none of us actually had.

Skyfall ? This movie hits a tiny bullseye, bringing James Bond into the 21st century while retaining everything there is to love about 007's world.
